I actually got this input of contacting congressman to implement this change, from USCIS only(their blog). I will also contact the ones mentioned in your posting. I also request all EB folks affected by this spillover usage not based on priority date, to contact them in addition to their local congressman. Let's not leave any stone unturned to make this happen, to help us all out. If this happens soon to create an impact, we may see some light in the upcoming bulletins. So all of you please do your part to contact them today(if not done already), I am on it now.

I opened a SR for non receipt of my FP notice, on 30Oct2007. I got a reply from USCIS exactly after 45 days ( very prompt) notifying me that " my FP has not yet expired or my FP is not yet cleared". Certainly this looks like a canned reply from USCIS which was sent even without looking at my file. I guess they should be more transparent in their process than just sending plain lies.

Can someone with a paypal account come forward and take over a fund? Anyone with a paypal account can donate any amount using a nickname and we can publish the nickname along with the amount donated on this thread. That way we have accountability and also have a better idea of how many flowers we can send. That person with the paypal account can then order the flowers on Saturday by the latest.
Others, if they want, can send the flowers on their own also.
Just a suggestion... If we can do this, I believe more people will come forward!

Well, following the discussion on BS and MS grads and some of the members cribbing why the MS(from US) students get special treatment, here are my 2 cents.
1) By makng sure that a person is MS they are making sure the population getting greencard is YOUNG !! , it's simple, highly educated "kids" who understand the US culture, since they have studied in US universities and have a whole life ahead of them to do good in Research etc.
Kids gel in fast for e.g if you see a person with BS and MS from the US, his behaviour is attuned to the society as compared to one who just has a MS and a BS from India.
2) On the other hand someone who has a MTech or worked 10 years in India, chances are these guys are already in their late 30's or 40's, so they are not getting the youth in, or a person who will take a lot more time to gel in the soceity as compared to the student.
3) Most importantly, they can't trust people whose degrees are not from the US. Their quality of education, their authenticity. Also, I think the quality of top 100 US univs, which most indians come to anyway, is much better than most of Indian Univs for MS. The kind of infrastructure and teaching they are exposed to is tremendous.
PS: Someone mentioned that PhD's get paid for reseach. Doing researrch is extremely demanding. I would rate it twice as demanding as a regular job! and the amount the students get is peanuts! Like ~$1500 a month for working ~ 60 hrs a week in research is hell !!
Unfortunately, in doing this you may loose some really good candidates, who may not have a US degree, but thats the price you pay "to be safe than sorry"

Of course illegal immigration issue is controversial and CIR may never succeed in its current form irrespective of who is in control of congress. A democrat leading congress may not venture into too controversial aspects of immigration fearing a backlash during presidential elections. The backlash they fear is energizing the extreme right wing. A republican leading congress anyway won�t pass CIR bill.
That�s why our best bet is SKILL bill � this is relatively non-controversial, good for American industry, and supported by different groups. Of course it is very difficult.

Even if some EB2 I guys are not happy with EB3 person porting to EB2, shouldn't they calm down as whoever is porting taking benefit from spillover for EB2 world and not from spillover EB2 I.
My assumption is spillover comes to "EB2" and not "EB2 + country" wise, if that is not correct then my point is nullified.
The number of visas are awared "(EB + FB) Country" wise. The 7% limit is on the total green cards issued to a country regardless of category. There are two types of spillovers
1) The spillover from EB1 -> EB2
2) The spillover from FB -> EB
In the first scenario the spill over happens from EB1 to EB2 regardless of category, the spillover visas do not have any country cap or other limitations and hence are awarded to the oldest priority date applicants in the EB2 category. (This is why China doesnt support country cap removal as USCIS gives the oldest application the highest priority and most of the older applications are from India). IFF all the EB2 categories are current and there are no more pending EB2 applications the visa numbers spill over to the next category i.e. EB3. Therefore until all of EB2 is current EB3 will not receive any spillover visas.
In the second scenario the spill over happens between the FB and EB categories. If a certain country has not used up its entire FB quota additional number of EB visa's will be made available to the applicants of that country. e.g. If Korea has a total limit of 100 visas, which are evenly split between the EB and FB categories so they each have a limit of 50 visas. Only 20 people applied in the FB categories but 80 people applied in the EB categories. USCIS will approve all those applications even though the EB applicants far exceeded the EB limit.

What happens when one filed labor under software engineer and then uses AC21 to switch jobs to a different company with a different job description like architect, product technologist or technical product manager.
The job description says designs architects and develops software. A product tecnologist,product manager or architect can be doing the same work in addition to other job functions.
I did use AC21. The law says (see 8 USC 1154(j)):
"A petition under subsection (a)(1)(D) of this section for an individual whose application for adjustment of status pursuant to section 1255 of this title has been filed and remained unadjudicated for 180 days or more shall remain valid with respect to a new job if the individual changes jobs or employers if the new job is in the same or a similar occupational classification as the job for which the petition was filed."
So salary, job locations, etc. do not matter. What does matter is the job classification. As long as you are in the same field and do the same or similar job, you'll be fine. My company's lawyer told me that they never had a problem with AC21 (company has 100,000+ employees).
Now, I am not sure if someone can leave the job, leave the US and come back 3 months later to work for a new employer. I think it's safer to have a continued employment.

After doing research, I am thinking that my case may move to Texas Service centre. If I get SRC receipt number, it will be good. My I-140 can be processed within 4 months.
Since it reached before July 30 it can reach anywhere !

And who is hurting because of this? Is it not you? And me? and our families? Whose fault is it that we refuse to actively participated in the effort that wants us to lead a stable life.
You see, most people here work in IT. So we have binary logic. 0 & 1. There is no in between. So most people in this community of educated illiterates wants the world to be perfectly aligned before we lift a finger. Lets wait for few more years for GC before we contribute my hard earned $20 after bickering for 10 years, way to go.

May be "educated illiterates" is a too strong word to describe our community. But no complaints, I know that sometime passion run high and we use strong words to convey our feelings. I know you mean all good for IV and the community.
I am contributing to IV with my time/money/efforts from a long time. I had several face to face interactions with people here in Colorado when I used to ask them why they shy away from fighting for what they deserve. Trust me, it would be unfair to say that people want someone else to fight on their behalf, but what people want is an organization that can represent them in a fair manner, and they feel that IV has a long way to go before that stage comes. Transparency in its action is one such big thing. Lets just learn from an anti immigration forum called numbersusa.com. On their donation page (http://www.numbersusa.com/content/action/make-donation.html) they clearly mention that "NumbersUSA is recognized by Independent Charities of America as one of the top 3% of well-run charities. When you donate to NumbersUSA, you can be sure that the money is used responsibly." Can we here at IV make such bold statement and prepare ourselves to prove this point if a member ask such question?
I am no way opposing this campaign, I am supporting this and going to contribute too. But I guess its not too much to ask where these contribution will go, and what track able results they might bring.
You see, most people here work in IT. So we have binary logic. 0 & 1. There is no in between. So most people in this community of educated illiterates wants the world to be perfectly aligned before we lift a finger. Lets wait for few more years for GC before we contribute my hard earned $20 after bickering for 10 years, way to go.

May be "educated illiterates" is a too strong word to describe our community. But no complaints, I know that sometime passion run high and we use strong words to convey our feelings. I know you mean all good for IV and the community.
I am contributing to IV with my time/money/efforts from a long time. I had several face to face interactions with people here in Colorado when I used to ask them why they shy away from fighting for what they deserve. Trust me, it would be unfair to say that people want someone else to fight on their behalf, but what people want is an organization that can represent them in a fair manner, and they feel that IV has a long way to go before that stage comes. I posted a summary of suggested reforms in IV as a organization, but unfortunately it did not spark that positive debate which can bring such reforms. You can read the thread in your leasure time:
