Been in the US since 1998, have an EB-2 PD of 2001, have played by the rules all along. Still no GC... And, the dates are going back to 2000 from the new year.. I've lost hopes...
I'm pretty close to getting clinical depression because of this game played by USCIS, Labor Dept, FBI and my own bad luck.
SKILL bill, OMNIBUS, etc. comes and goes. IV does seem to be doing things to lobby for the community, but let's face one reality. Like a news article said, no one in congress or senate wants to touch immigration even with a long pole until 2009.
The US has been very good to me (other than the GC part), more than my home country (India) which is why I'm still here.
Have invested too much of time in this country to just pack up and go. Just curious if any of you feel this way? How do you handle such depressing feelings?

Being working in a non-cap h1b and in same place for the past 7 years(went to school also here). I am desperate for a new job which obviously will take me to new place.
With an EAD and approved i-140 i can't use being single.
had i known 0.1 % of immigration rules 3 years back...then i would not have accepted this non-caped h1b job.
All i need now is not GC...I just need a caped h1b. I can even trade in my GC benefits for this....!!!
But i am not depressed.. i have accepted this has another options for myself.

Things are very different in India now compared to when I came to the US (1999). Infact, I might not have taken the decision to come to the US had conditions been what they are now i.e. economy, job situation etc.
That being said, its a personal choice for most people - based on family ties, job situation, field of work and the reason for coming to the US/leaving India.

People, the bill is called "Comprehensive Immigration Reform". It can only be comprehensive if it takes into account the legal population and the illegal population. This bill could not come at a better time for us with the mid-term elections coming up. The Executive Branch of Government is pressuring for passage of this legislation. It will be a huge issue for the mid-term elections. The Republican House is in a no win situation, passage means amnesty (their words, not mine) and non-passage makes them look ineffective. For now all we can do is sit back and wait and watch. It will take the majority of the house spin doctors a while to figure out how to proceed with maximum benefit for the Republican Party. This is the nature of politics.
For a little entertainment, we can always predict next months visa bulletin! (Sorry, I couldn't resist).

Employer can revoke I-140 anytime until I-485 is approved. After 180 calendar days of I-485 filing date, employee can continue I-485 seeking AC-21 protection . Employee must have open permanent job offer from another employer. The new job must be same or similar.

When ever IV go and seek advise from Law firm or lobby firm they charge some money. No one is giving free advise in USA. We cannot run random campaign becasue people will not participate if no out come. We need to find out perfect time. Also we , and IV are common people who came from foriegn country and have no idea of whole US immigration system but law / lobby firm do.
If you and other sincere member contribute and participate activelly we may achive something. May be just giving few USD will not help. But there were so many anti coming to site and harming our agenda. since we have donor forum few anti come there. So if you are serious do contribute and get donor status. Participate in state chapter and work with IV and all of us. That will make date current for all.
So who is the leader who is responsible of DOING stuff with that money when I contribute

Sanju my friend, why sarcasm ? This is such wonderful information, why can't this be made more public, posted in a prominent position on IV ? Why should members do research to get this info when it can be relatively easily acquired by Quinn Gillespie & Assoc and given to core ? Having a permit means you can block the traffic.
Without a permit, we are required to stay on sidewalks.
The police put down my name, driver license # and address.
However, when I asked if I have any liability for others fault, the ploice said NO. Everybody abides by law for himself.

Like many others on these forums, I have given up significant opportunities because I believed mistakenly that the GC mess would be cleared up in 2-3 years. Sometimes that does lead to extreme frustration - My wife often jokes that when I do actually receive my GC, I will have lost a very convenient excuse that the lack of one is holding me back. :-)
To those who are starting down this path, I have this piece of unsolicited advice. If you feel that you are depressed and this is affecting your health and/or your family, it may be best to move on - the world is a big place, full of opportunity; opportunities that cannot be quantified by an O*NET job code. Enjoy everyday while you can - you only live once.

I can tell you there are roughly 100,000 labor applications filed (50,000 EB3) between Aug 2003 and Dec 2003 for EB India category. The reason was everybody wanted to clear thru regular process before PERM takes over. Those Labors filed after Aug 2003 and before PERM started are moved into backlog and are fully cleary last 4 th quarter. And so 90% of those EB3s may be still there (45,000) hanging. EB2s could have been cleared substantially till Dec 2003. It is all my guess work and not sceintific or factual. also ..this looks very inaccurate ..because I know lot of indians who got H1 during the peak (when h1 was 195k) have gone back. i.e either they got better oppurtunities back home or just went back as they were not getting jobs. I did stay in one of the guest house which had lots of consultants ..none of them are here anymore !!
